Proposed Amendments
2007-31 - Proposed Amendment of Rule 4.201 of the Michigan Court Rules
The proposed amendment of MCR 4.201(G)(1)(b) would clarify that service of process for purposes of a money claim is sufficient if completed pursuant to MCR 2.105; otherwise, if the defendant does not appear or file an answer to the complaint, a money claim must be dismissed without prejudice, or adjourned until service of process is complete.

SBM Animal Law Section Symposium Set For Friday, April 11

Sections and Committees
The Judicial Conference section submitted a public policy position on the following bills:
SB 1001 Civil procedure; civil actions; sanctions for advocating a frivolous claim or defense in a civil action; allow court to impose sanctions in addition to costs and attorney fees. Amends sec. 2591 of 1961 PA 236 (MCL 600.2591).

SB 1002 Civil procedure; costs and fees; attorney fees; require losing party to pay winning party's fees in a civil lawsuit. Amends 1961 PA 236 (MCL 600.101 - 600.9947) by adding sec. 2443.

The Probate & Estate Planning Section submitted a public policy position on SB 1200 Civil procedure; garnishment and attachment; higher education savings plans; exempt from enforcement of court judgments or bankruptcy. Amends secs. 5451 & 6023 of 1961 PA 236 (MCL 600.5451 & 600.6023).
